Arizona Emancipation of Minor is a legal process in the state of Arizona that allows minors (persons under the age of 18) to become legally independent of their parents or guardians. The emancipation process grants the minor the rights and responsibilities of an adult, including the ability to enter into contracts, work, and manage their own finances. The process is available to any minor who is at least 16 years old and can demonstrate the ability to manage their own affairs. There are two types of Arizona Emancipation of Minor: voluntary emancipation and court-ordered emancipation. Voluntary emancipation requires the minor to obtain parental or guardian consent or, if the minor is 16 or 17, to have the parent or guardian complete an affidavit of consent. Court-ordered emancipation requires the minor to file a petition in court and demonstrate that emancipation is in the minor’s best interest. The court may also require the minor to have a guardian ad item appointed to represent the minor’s interests in the proceeding.
