The California Application for Extension of Time to File a Response to a Criminal Complaint is used by defendants to request additional time to respond to a criminal complaint or indictment. This form must be filed with the court within 10 days of being served with the criminal complaint. The California Application for Extension of Time to File a Demurrer is used by defendants to request additional time to file a demurrer (a legal document used to challenge the sufficiency of facts in a criminal complaint). This form must be filed with the court within 10 days of the date the demurrer is due. Both forms must be signed by the defendant and their attorney (if applicable).
