The California Petition for Dismissal — Military Personnel is a legal document that allows military personnel to file a motion to dismiss their criminal charge(s) in the state of California. It is an alternative to a guilty plea or conviction, and it is typically used when the court finds that the individual has met the criteria for dismissal of the charge. There are three types of California Petition for Dismissal — Military Personnel: 1) Pre-Trial Diversion Programs; 2) Pre-Trial Intervention Programs; and 3) Post-Trial Intervention Programs. Pre-Trial Diversion Programs involve the military personnel completing a court-ordered program and/or paying a fee in exchange for dismissal of the charge. Pre-Trial Intervention Programs involve the military personnel participating in a court-ordered program and/or paying a fee in exchange for dismissal of the charge. Post-Trial Intervention Programs involve the military personnel completing a court-ordered program and/or paying a fee in exchange for dismissal of the charge, after conviction.
