California Prosecuting Agency's Response to Petition or Application — Health and Safety Code 11361-8 — Adult Crimes consists of the following: 1. Review Petition: The prosecuting agency will review the petition or application to determine if it meets the requirements of Health and Safety Code 11361-8. 2. Investigation: The prosecuting agency will conduct an investigation to determine if the petitioner or applicant has a valid claim and to determine facts relevant to the case. 3. Plea Negotiations: If the prosecuting agency finds probable cause to believe a crime has been committed, plea negotiations may be pursued in order to resolve the case. 4. File Charges: If plea negotiations are unsuccessful or if the prosecuting agency finds sufficient evidence to charge, the agency will file charges against the accused in accordance with Health and Safety Code 11361-8. 5. Prosecution: The prosecution will then proceed to trial in order to prove the accused's guilt beyond a reasonable doubt. 6. Sentencing: If the accused is found guilty, the court will impose a sentence as provided under Health and Safety Code 11361-8.
