The California Request to Modify or Terminate Elder or Dependent Adult Abuse Restraining Order is a document that can be filed in California court by a person who is subject to an existing Elder or Dependent Adult Abuse Restraining Order. This document requests either a modification or termination of the existing order. There are two types of California Request to Modify or Terminate Elder or Dependent Adult Abuse Restraining Order: 1) Modification Request and 2) Termination Request. A Modification Request is a written request to the court to modify the existing Elder or Dependent Adult Abuse Restraining Order. This request may ask for changes to the restrictions or conditions of the order, such as changing the duration or geographical scope of the order. A Modification Request must explain why the modification is needed and provide evidence of any changes in circumstances that justify the modification. A Termination Request is a written request to the court to terminate the existing Elder or Dependent Adult Abuse Restraining Order. This request must explain why the order should be terminated and provide evidence that the conditions that led to the issuance of the order no longer exist or have been addressed. Both Modification and Termination Requests must be signed by the petitioner and filed in the court in which the restraining order was issued. The court will then consider the request and decide whether to grant or deny it.
