California Request and Notice of Hearing Regarding Health Insurance Assignment is a document issued by the California Department of Managed Health Care (DMC). It is designed to ensure that health insurance companies comply with California's health insurance laws. There are two types of Request and Notice of Hearing: (1) Assignment of Benefits, and (2) Direct Payment of Benefits. The Assignment of Benefits Request and Notice of Hearing is used when a health insurance company has failed to comply with the State's laws regarding assignment of benefits, such as refusing to cover a medical service or refusing to pay for a medical service. The Direct Payment of Benefits Request and Notice of Hearing is used when a health insurance company has failed to comply with the State's laws regarding direct payment of benefits, such as not paying a medical bill or not paying a medical provider within the required time frame. Both Request and Notice of Hearing must provide the insurance company with the opportunity to respond to the complaint and explain why the action was taken. If the insurance company does not respond or fails to adequately explain the action taken, then a hearing may be scheduled by the DMC.
