California Response to Gun Violence Emergency Protective Order (RPO) is a legal order issued by a court that temporarily restricts the access of a person to firearms and ammunition when they pose a significant risk of causing personal injury to themselves or others. RPO can be issued by a court based on findings of clear and convincing evidence that the subject poses an immediate and present danger of causing personal injury to themselves or others by having access to firearms and ammunition. There are two types of California Response to Gun Violence Emergency Protective Orders: (1) Gun Violence Restraining Orders (GYRO); and (2) Extreme Risk Protection Orders (RPO). A GYRO is issued by a court based on findings of clear and convincing evidence that the subject poses an immediate and present danger of causing personal injury to themselves or others by having access to firearms and ammunition. This order can be issued by a family member, law enforcement officer, or employer. An RPO is a court-issued order that prohibits a person from purchasing, possessing, or receiving firearms and ammunition for up to one year if they are found to present an immediate and present danger of causing personal injury to themselves or others by having access to firearms and ammunition. Both types of orders can be issued ex parte, meaning without the subject present, and can be enforced by law enforcement. If issued, the subject must surrender any firearms and ammunition in their possession and refrain from purchasing or receiving any firearms or ammunition while the order is in effect. The order can be extended upon request and may be modified or terminated at any time.
