California Petition for Gun Violence Restraining Order is a legal document created by the state of California that allows family members, intimate partners, employers, co-workers, and law enforcement officers to petition the courts to temporarily prohibit a person from possessing or purchasing a firearm or ammunition. This restraining order can be issued for up to one year, and can be extended if necessary. The petitioner must provide evidence that the person in question poses an immediate and present danger of causing personal injury to themselves or another person with a firearm. There are two types of California Petition for Gun Violence Restraining Order, Emergency and Ex Parte. An Emergency Petition can be filed when an imminent threat of violence is present, and the court will review the petition within 24 hours of filing. An Ex Parte Petition is a longer process, and the court will review the petition within 15 court days of filing.
