California Order on Request to Renew Gun Violence Restraining Order (GYRO) is a type of restraining order issued by a court in California after a hearing. The purpose of the order is to protect victims of gun violence from harassment, stalking, and the risk of further violence from the person from whom the order was issued. A GYRO prohibits a person from owning, possessing, purchasing, receiving, or having in their custody or control any firearms or ammunition for the duration of the order. It also requires the person to surrender any firearms or ammunition they have in their possession or control to law enforcement. There are two types of California Order on Request to Renew Gun Violence Restraining Order: 1. Ex Parte Gun Violence Restraining Order: This type of order is issued without notice to the person from whom the order was issued. An ex parte order is usually issued when there is an immediate risk of violence or threat of harm. 2. Permanent Gun Violence Restraining Order: This type of order is issued after a hearing and remains in effect until the court orders it terminated or modified. A permanent GYRO can be issued for up to five years. For both types of orders, the court may also require the restrained person to undergo a mental health evaluation.
