The California Agreement of Parent or Indian Custodian to Temporary Custody of Indian Child (CAPICTCIC) is an agreement between an Indian parent or Indian custodian and a non-Indian temporary custodian of an Indian child for the purpose of providing temporary care for the child. This agreement is used when an Indian child is placed in a temporary custodial situation, such as when the parent or custodian is unable to care for the child due to illness, death, or other crisis. This agreement is meant to protect the rights of the Indian child and ensure the child’s best interests are considered. There are two different types of CAPICTCIC: Simple and Complex. A Simple CAPICTCIC is used in situations where the parent or custodian agrees to the temporary custodial arrangement and the temporary custodian agrees to provide temporary care for the child. A Complex CAPICTCIC is used in situations where the parent or custodian is unable to provide consent or where the temporary custodian is unable to agree to the terms of the temporary arrangement. The CAPICTCIC includes information such as the name of the Indian child, the name of the parent or custodian, the name of the temporary custodian, and the duration of the arrangement. It also includes the terms of the agreement, which detail the responsibilities of the parent or custodian and the temporary custodian, the rights of the Indian child, and any other provisions that may be necessary to ensure the best interests of the child are met.
