California Request For Dismissal is a legal procedure that allows individuals to dismiss their criminal charges and convictions without having to go to trial. It is a form of alternative resolution to a criminal case, and can be used to dismiss certain misdemeanors, infractions, and felonies. This procedure is available in California under Penal Code 1385, and is commonly referred to as a “1385 Motion” or “PC 1385 Motion”. There are two main types of California Request For Dismissal: Proposed Dismissal and Judicial Discretionary Dismissal. Proposed Dismissal is a type of dismissal where the court agrees to dismiss the case if certain conditions are met, such as the defendant completing a certain program or a certain amount of time passing without a new offense being committed. Judicial Discretionary Dismissal is a type of dismissal where the court has the discretion to dismiss the case on its own, without the defendant having to necessarily meet certain conditions.
