The California Declaration In Support of Ex Parte Application For Orders is a legal form that is used by a party to a legal action in order to ask the court for a temporary order without the other party being present. This type of declaration is often used when the other party cannot be found or is otherwise unavailable to appear at court. The declaration must be sworn and signed under penalty of perjury, and must include a statement of the facts that form the basis of the request for the order. There are two types of California Declaration In Support of Ex Parte Application For Orders: 1) Injunctive Relief and 2) Temporary Restraining Order (TO). The Injunctive Relief type is used when one party seeks an order from the court that will prevent another party from taking a certain action or that will require the other party to take a certain action. The TO type is used to request an order that will prevent another party from taking certain actions until the court has had an opportunity to hear from both parties in a full hearing.
