The Colorado Statement Under Penalty of Perjury Concerning Payment Advices is a document that employers must fill out and submit to the Colorado Department of Labor and Employment (COLE) to certify that all wages due an employee have been paid. This statement must be completed and signed by the employer under penalty of perjury. There are two types of Colorado Statements Under Penalty of Perjury Concerning Payment Advices. The first type is a general statement, which is used when an employee has resigned or been terminated and all wages due have been paid in full. The second type is an amended statement, which is used when an employee has been paid less than the wages due and the difference must be reported to the COLE. The Colorado Statement Under Penalty of Perjury Concerning Payment Advices must include the employer's name and address, employee's name and last four digits of their Social Security number or Alien Registration number, the period or dates of employment, the employee's regular pay rate, and the total amount of wages due and the date the wages were paid. The employer must sign and date the statement, and include the statement in the employee's final pay. The form must be completed and submitted to the COLE within 14 days of the employee's termination or resignation. Failure to comply with this requirement can result in civil and criminal penalties.
