Connecticut Administrative Appeals Under General Statutes Section 4-183 -- Notice of Filing (For use when service is made by a proper officer or indifferent person) is a document that is used when a party or parties file an appeal or motion for an administrative hearing. The Notice of Filing is provided to the other party or parties in order to provide them with information regarding the filing of the appeal or motion. The Notice of Filing must be served upon the other party or parties by a proper officer or indifferent person. The Notice of Filing must contain the following information: the name of the filing party, the date of filing, the name of the agency or court in which the appeal or motion is being filed, the name of the clerk or other proper officer of the agency or court, and the address of the agency or court. Additionally, the Notice of Filing must include a statement that the filing party is entitled to a hearing, an explanation of the process for obtaining a hearing, and a statement of the consequences of not responding to the notice. The Notice of Filing must be served upon the other party or parties prior to the hearing date in order for the hearing to be valid. There are two types of Notice of Filing: Service by a Proper Officer and Service by an Indifferent Person. Service by a Proper Officer is when the Notice of Filing is served by a law enforcement officer or other government official. Service by an Indifferent Person is when the Notice of Filing is served by a private individual who is not a party to the case.
