Pursuant to this Agreement, Contractor agrees to indemnify Owner against any and all liability, demands, claims, losses, damages and expenses, for injuries to persons or property in connection with Contractor’s performance of its duties pursuant to this Agreement, but only to the extent that insurance proceeds are available.
