A Delaware Notice of Motion for Relief from Stay is a legal document that is filed with the court in the State of Delaware in order to seek permission to proceed with certain activities that would otherwise be prohibited due to an active bankruptcy stay. There are two types of Delaware Notice of Motion for Relief from Stay: (1) an individual debtor’s request for relief from stay; and (2) a creditor’s request for relief from stay. In an individual debtor’s motion, the debtor must provide the court with a detailed explanation of why their activities should be allowed under the bankruptcy laws, which may include the need to pay bills or collect income. The creditor’s motion generally requests permission to collect on a debt or to foreclose on secured property. Both motions require supporting documentation, such as financial statements, to prove that the activities requested are necessary and would not interfere with the debtor’s bankruptcy plan.
