The Delaware Affidavit of Jurisdiction over a Non-Resident is a document used to establish jurisdiction over a non-resident defendant in a Delaware court. This document is required for any legal action taken against an out-of-state defendant in the state of Delaware. The Affidavit of Jurisdiction over a Non-Resident must be signed by the Attorney General of Delaware and must include the following information: the name and address of the defendant, the defendant’s place of residence, the defendant’s place of business, the nature of the action, and the grounds on which jurisdiction is being sought. There are two types of Delaware Affidavit of Jurisdiction over a Non-Resident: a General Affidavit of Jurisdiction and a Limited Affidavit of Jurisdiction. A General Affidavit of Jurisdiction is used when the defendant is not a resident of Delaware and the court has no jurisdiction to hear the case. A Limited Affidavit of Jurisdiction is used when the defendant is a resident of Delaware, but the court does not have jurisdiction to hear the case.
