A Delaware Affidavit of Process Server is a document used to certify that a process server has successfully served a summons, complaint, or other legal document in the state of Delaware. This document is required when a lawsuit or other legal document is being served by a professional process server. It is used to provide proof of service to the court and any other parties involved in the case. The Delaware Affidavit of Process Server must be completed and signed by the process server and notarized by a Delaware notary public. There are two types of Delaware Affidavit of Process Servers: personal service and substituted service. Personal service requires a process server to personally serve the documents to the recipient or their agent. Substituted service is when the process server gives the documents to someone over the age of eighteen who lives at the same residence as the recipient. This person must sign an affidavit of delivery, which is included in the Delaware Affidavit of Process Server.
