The Delaware Affidavit of Service of a Non-Resident is a legal document used to prove that a defendant was served with legal documents in an action filed in the State of Delaware but who is not a resident of the state. This document is usually used when a defendant cannot be physically served with the legal documents and must be notified through alternate methods, such as by mail, email, or publication of a legal notice in a newspaper. The affidavit is signed by an individual who is not a party to the action and who is knowledgeable about the facts as to how the defendant was served. There are two types of Delaware Affidavit of Service of a Non-Resident: the Affidavit of Service by Mail and the Affidavit of Service by Publication. The Affidavit of Service by Mail is used when legal documents are served by mail, and the Affidavit of Service by Publication is used when legal documents are served by publication of a legal notice in a newspaper. Both documents must be completed with the defendant’s name, address, and the date and manner of service.
