A Delaware Request for Continuance of Mediation (or “RFM”) is a document that is filed with the Delaware Court of Chancery to seek an extension of time for a court-ordered mediation process. The filing party typically requests an additional period of time to continue to work towards a settlement outside of court. The Delaware Court of Chancery may grant the RFM if the parties are in good faith effort of negotiations, and the court believes that the additional time will help move the parties closer to a resolution. There are two types of Delaware Request for Continuance of Mediation: a stipulated RFM and an unopposed RFM. A stipulated RFM is agreed upon by both parties and filed with the court. An unopposed RFM is filed by one party without the agreement of the other party, and is then reviewed by the court. The court may accept the RFM, deny the RFM, or grant the RFM with conditions.
