Delaware's distracted driving laws are codified in Title 21, Section 4176C of the Delaware Code. The law prohibits drivers from using handheld electronic devices while operating a motor vehicle. This includes texting, browsing the internet, and making or receiving phone calls without using a hands-free device.

Drivers cannot have a phone in their hand or touching any part of their body while talking on their phone while driving. The fine for a first conviction is $50.00 and 1 point assesed against the driver's license.

Texting and driving is illegal in 48 states and the District of Columbia. A smaller number of states (24 and the District of Columbia) have bans on drivers using any handheld devices while behind the wheel.

In the first six months, novice drivers must be supervised by a licensed parent or other approved adult sponsor at all times while driving a motor vehicle. During the second six months, the novice driver may drive from a.m. - p.m. without adult supervision.

Cell Phone and Texting Law Delaware's hands free cell phone law has been in effect since 2011 and bans all drivers from using hand held smart phones, cell phones, tablets, laptops, games or other portable computers while driving.

Cell Phone and Texting Law Drivers are not allowed to talk without using a hands-free device, read, write or send text messages, email or use the Internet while operating a motor vehicle. Drivers caught using a hand-held device will be fined $100 for their first offense.
