The Delaware Unemployment Insurance Appeal Board Appeal (IAB) is a board established by the Delaware Department of Labor to hear appeals from individuals who have been denied unemployment insurance benefits. The IAB hears appeals from claimants, employers, or their representatives, and makes decisions regarding the amount of benefits to be paid, the eligibility of claimants, and the reasonableness of employer decisions. The IAB consists of five members appointed by the Governor and confirmed by the Senate, and it is chaired by a labor representative. The IAB hears two types of appeals: (1) appeals of decisions of the Delaware Department of Labor regarding claim eligibility or benefit amount; and (2) appeals of employer decisions regarding the reasonableness of a claimant’s decision to leave employmentTribalAB also has the authority to review and modify employer decisions regarding the reasonableness of a claimant’s decision to leave employmentTribalAB also holds hearings and issues decisions regarding appeals of employer decisions regarding the reasonableness of a claimant's decision to leave employment. The IAB also has the authority to review and modify employer decisions regarding benefit eligibility and the amount of benefits to be paid. The IAB makes decisions based on the facts and evidence presented at hearings and on the applicable Delaware law. The decisions of the IAB are final and binding unless they are appealed to the Delaware Supreme Court.
