A Florida Affidavit in Compliance with Uniform Child Custody Jurisdiction and Enforcement Act (McCrea) is a legal document used to establish a parent’s right to seek custody or visitation with a child in the state of Florida. This affidavit is used to demonstrate that a parent has a “home state” that has jurisdiction to make decisions regarding the custody of the child. It is also used to establish that the child has significant connections with the state of Florida, such as living there for at least six consecutive months. There are two types of Florida Affidavit in Compliance with McCrea: a Petitioner’s Affidavit and a Respondent’s Affidavit. The Petitioner’s Affidavit is used by the party that is initiating the custody proceedings, while the Respondent’s Affidavit is used by the party that is responding to the custody proceedings. Both affidavits must be signed by the parties involved in the custody proceedings and notarized by a notary public in order to be valid. The affidavit must also include information about the parties involved, such as names, addresses, and contact information. Both affidavits must also include information about any prior legal proceedings related to custody, and any other relevant facts about the child’s connections to Florida.
