A Florida Affidavit of Diligent Search And Inquiry (Probate) is a document used in the probate court for the purpose of determining the rightful heirs of a deceased person's estate. It is signed by a person who is appointed to conduct a search for potential heirs of an estate, and is intended to serve as evidence that a diligent search and inquiry has been conducted. There are two types of Florida Affidavit of Diligent Search And Inquiry (Probate): Affidavit of Diligent Search and Inquiry — Heirs of Deceased Person and Affidavit of Diligent Search and Inquiry — Unknown Heirs of Deceased Person. The former is used when the deceased person's heirs are known, while the latter is used when the heirs are unknown. The affidavit must include the name of the deceased, any known heirs, a list of all known potential heirs, and a description of the search and inquiry that was conducted to locate potential heirs. The affidavit must be filed with the probate court in order to prove to the court that all potential heirs have been identified and that a diligent search and inquiry has been conducted.
