Georgia Consent Order — Pretrial House Arrest is a legal agreement between the court and the defendant that involves the defendant being placed under pretrial house arrest rather than in jail or prison. This type of arrangement is usually reserved for those defendants who are considered to have a low risk of flight and/or a low risk of reoffending. The defendant is typically required to remain at home, except for approved activities such as court appearances, medical appointments, and work. They are also monitored by a home confinement officer or other appropriate agency, which ensures that the conditions of the Georgia Consent Order are met. There are two types of Georgia Consent Order — Pretrial House Arrest: Electronic Monitoring and Traditional House Arrest. Electronic Monitoring requires the defendant to wear an electronic device that transmits their location to a monitoring agency. Traditional House Arrest requires the defendant to stay confined to their home and only leaves with approval from the court or an approved agency.
