A Hawaii Transfer Case (Debtor's Motion) is a legal action taken by a debtor to transfer a debt from one court to another. This is done when the debt is owed to a creditor in a different jurisdiction or when the debtor wishes to have the case heard in a different court. There are two types of Hawaii Transfer Case (Debtor's Motion): 1) Inter-District Transfer and 2) Intra-District Transfer. An Inter-District Transfer is when the debtor wants to transfer the case to a court in a different Hawaii judicial district. An Intra-District Transfer is when the debtor wants to transfer the case to a court within the same Hawaii judicial district. Both types of transfer require the debtor to file a motion in the court where the case is currently pending. The motion must include the reasons for the transfer, the original court’s order, and the proposed court’s order. The court may grant or deny the request depending on the merits of the case. It is important to note that the transfer of the case does not relieve the debtor of their responsibility to pay the debt.
