A Hawaii Complaint (Repletion) is a legal document used to recover personal property in the state of Hawaii. It is used when one party claims ownership of a piece of personal property, and the other party refuses to give it up. There are two types of Hawaii Complaints (Repletion): repletion with damages and repletion without damages. In a repletion with damages, the plaintiff is seeking not only the return of their property, but also money damages. The plaintiff must prove that they have a legal right to the property, and that the defendant wrongfully withheld it from them. In a repletion without damages, the plaintiff is only seeking the return of their property. The plaintiff must prove that they have a legal right to the property, and that the defendant wrongfully withheld it from them. They do not have to prove that they suffered any damages as a result of the defendant’s actions. The Hawaii ComplaintRepletionin) must be filed in the appropriate court in the county where the property is located. The defendant must be served with a copy of the complaint and a summons. The defendant then has the option to file an answer to the complaint. If the defendant does not file an answer, the court may grant a default judgment and order the property to be returned to the plaintiff.
