Hawaii Motion to Dismiss is a document filed in a Hawaii court by a defendant in a civil suit. It requests the court to dismiss the complaint against the defendant because the plaintiff has failed to state a legal claim or because the plaintiff lacks the capacity to bring the suit. The Motion to Dismiss is also known as a demurrer. There are two types of Hawaii Motion To Dismiss: a) a Demurrer, which argues that the plaintiff's complaint fails to state a legally sufficient claim; and b) a Motion to Dismiss, which argues that the plaintiff lacks the capacity to bring the suit or that the defendant has a valid defense to the action. In either case, the defendant must provide evidence to support their claim. If the court grants the Hawaii Motion To Dismiss, the plaintiff's case is dismissed with prejudice, meaning they cannot file the same claim against the defendant again.
