Hawaii Ex Parte Motion is an emergency court filing that a party can make to seek immediate relief from the court without giving notice to the other party. Ex Parte Motions are used when immediate action is needed, such as to prevent irreparable harm, and the requesting party believes that the relief sought is in the best interest of justice. The three types of Hawaii Ex Parte Motion are Temporary Restraining Orders, Preliminary Injunctions, and Emergency Hearings. A Temporary Restraining Order (TO) is a court order that requires the other party to cease a certain activity or take some other action. A Preliminary Injunction is a court order that requires the other party to take, or refrain from taking, certain actions until a hearing can be held. An Emergency Hearing is a hearing that is held to resolve a dispute on short notice.
