An Iowa Notice of Appeal (Cross-Appeal) (Child In Need Of Assistance And Termination Cases) is a legal document filed with the Iowa Court of Appeals when a party wishes to challenge a lower court’s decision in a child in need of assistance (CHINA) and/or termination of parental rights case. The Notice of Appeal (Cross-Appeal) must be filed within 30 days of the lower court’s ruling. It must include the names of all parties involved, the lower court’s ruling, and the grounds for the appeal. There are two types of Iowa Notice of Appeal (Cross-Appeal) (Child In Need Of Assistance And Termination Cases): direct appeals and cross-appeals. Direct appeals are filed by parties who were parties to the original CHINA or termination case and wish to challenge the lower court’s ruling. A cross-appeal is filed by a party who was not a party to the original case, but wishes to challenge the lower court’s ruling. The Notice of Appeal (Cross-Appeal) must be accompanied by a filing fee, copies of all papers previously filed in the case, and proof of service on all parties. The filing party must also submit a brief to the Court of Appeals outlining their arguments. The Court of Appeals will then review the appeal and issue a decision.
