An Idaho Notice of Appeal is a document that is filed with the Idaho Supreme Court by a party that wishes to initiate an appeal from a lower court’s decision. A Notice of Appeal is required in order to begin the appeals process in Idaho. There are three types of Idaho Notice of Appeal: (1) Notice of Appeal (Civil) for appeals from a district court or magistrate court decision; (2) Notice of Appeal (Criminal) for appeals from a district court or magistrate court decision involving criminal matters; and (3) Notice of Appeal (Administrative) for appeals from an administrative decision. All notices of appeal must be filed with the Idaho Supreme Court and must include certain information, including the nature of the appeal, the lower court decision being appealed, the names of the parties involved, and a certificate of service. The filing fee must also be paid at the time of filing. The Idaho Notice of Appeal must be filed within 30 days of the date of the lower court’s decision in order to preserve the right to appeal.
