An Illinois Small Claim Complaint is a legal document that is filed when a person or business wishes to pursue a claim against another person or business in the state of Illinois for damages or payment of an obligation that is valued at $10,000 or less. There are three types of Illinois Small Claim Complaints: 1) Claims for Money Damages, 2) Claims for Personal Property, and 3) Claims for Possession of Personal Property. For Claims for Money Damages, the plaintiff must prove a specific amount of money is owed by the defendant and the defendant must prove that the amount owed is less than the amount claimed by the plaintiff. For Claims for Personal Property, the plaintiff must prove they are entitled to the property and the defendant must prove that they are the rightful owner of the property. For Claims for Possession of Personal Property, the plaintiff must prove that they have a legal right to possession of the property and the defendant must prove that they are the rightful owner of the property.
