The Illinois Affidavit of Special Process Server is a document used to appoint an individual to serve legal documents on a specific party. This document is also known as a Special Process Server Bond and is required by the Illinois Supreme Court Rule 11(a). It is used to ensure that the individual chosen to serve legal documents is qualified to do so. The Affidavit is required when the individual is not a sheriff or a deputy sheriff. There are two types of Illinois Affidavit of Special Process Server: a single-purpose affidavit and a multi-purpose affidavit. The single-purpose affidavit is used to appoint the individual to serve legal documents for a specific case. The multi-purpose affidavit is used to appoint the individual to serve legal documents for multiple cases. The Affidavit must be signed by the individual being appointed, the appointing party, and two witnesses. It must also be notarized and filed with the court. The Affidavit must include the name and address of the individual being appointed, their qualifications and certifications, the appointment, and the duration of the appointment. The duration of the appointment is typically one year.
