The Illinois Order for Investigation of an Applicant for a Certificate of Relief from Disabilities (“Order”) is an order issued by the Illinois Department of Financial and Professional Regulation (ID FPR) to investigate the background of a person who has applied for a Certificate of Relief from Disabilities (CRD). The Order requires ID FPR to investigate the applicant’s criminal history, prior offenses, and other relevant information to determine if they are eligible to receive a CRD. The Order is issued to applicants who have been convicted of certain offenses and wish to have those convictions removed for the purposes of professional licensure or other professional activities. The Order generally outlines the criminal history and prior offenses that must be reviewed to determine eligibility for a CRD. There are two types of Illinois Order for Investigation of an Applicant for a Certificate of Relief from Disabilities: 1. Non-Consensual Order: This type of Order is non-consensual, meaning that the ID FPR does not require the applicant’s written consent to investigate their background. The ID FPR will initiate an investigation on their own accord to determine whether the applicant is eligible to receive a CRD. 2. Consent Order: This type of Order requires the applicant’s written consent to be investigated. The applicant must sign a form indicating that they consent to the investigation and authorize the ID FPR to access their criminal history and prior offenses. Once the form is signed, the ID FPR will then begin the investigation to determine eligibility for a CRD.
