The Illinois Uniform Order for Support (DUOS) is a legal document issued by the court to enforce payment of child support, spousal maintenance, and/or health insurance premiums. It is issued by the court in all divorce, paternity, and other family law cases in which the parties need a court order to establish a payment schedule for the support of children and/or spouses. The DUOS are created by the Illinois Department of Healthcare and Family Services, and is the only order for support that is approved in Illinois. There are two types of Illinois Uniform Orders for Support. The first is a Notice of Support Obligation, which establishes the amount of child support to be paid and the frequency of payments. The second is called an Allocation Judgment, which is an order of the court requiring the payment of spousal maintenance or payment of health insurance premiums. In either type of order, the court must consider factors such as the income of the parties, the needs of the children, and the standard of living during the marriage. The court may also require the payment of attorney's fees and costs, or require the payment of a lump sum or periodic payments. The DUOS are binding on both parties, and can be enforced by the court. If a party fails to comply with the provisions of the order, the court may hold the non-compliant party in contempt or impose other sanctions.
