The Illinois Memorandum of Agreement-No Agreement (MOA-No Agreement) is a document used by two or more parties in a dispute to settle their differences without the need for a formal agreement or contract. This document is used by parties to acknowledge that they have reached a mutual understanding and to memorialize their understanding of the dispute. Through this document, the parties are able to document their understanding of the situation, without having to go through the time and expense of negotiating and executing a formal contract. There are two types of Illinois Memorandum of Agreement-No Agreement: the Standard MOA-No Agreement and the Mutual Reservation of Rights MOA-No Agreement. The Standard MOA-No Agreement is used when the parties are in agreement about the dispute and are willing to cooperate to resolve it without entering into a formal contract. The Mutual Reservation of Rights MOA-No Agreement is utilized when the parties have not agreed on the terms of the dispute, but wish to document their understanding of the issue and the steps each party will take to address it.
