An Illinois Notice of Motion to Stay Foreclosure Sale is a document used to request a temporary halt of a foreclosure sale in the state of Illinois. It is typically filed by the borrower or a representative of the borrower in order to provide more time to negotiate a loan modification or other alternative to foreclosure. The notice must include information such as the name, address, and telephone number of the borrower; the name, address, and telephone number of the party filing the motion; the names of the parties involved in the foreclosure action; the date and time of the scheduled foreclosure; and, a description of the relief requested. There are two types of Illinois Notice of Motion to Stay Foreclosure Sale: an Emergency Motion to Stay Foreclosure Sale and a Non-Emergency Motion to Stay Foreclosure Sale. An Emergency Motion to Stay Foreclosure Sale is used when the foreclosure sale is imminent or has already taken place, and it is filed in order to halt the sale and give the borrower more time to negotiate a loan modification or other alternative to foreclosure. A Non-Emergency Motion to Stay Foreclosure Sale is used when the foreclosure sale is still some time away, and it is filed in order to provide the borrower with more time to negotiate a loan modification or other alternative to foreclosure before the sale takes place.
