The Illinois Notice of Appeal is a legal document filed in the state of Illinois to formally appeal a judgment or decision from a lower court. It is typically used in civil cases, although it can also be used in criminal cases. The Notice of Appeal must be filed within 30 days of the original judgment or decision, and it must be filed with the Clerk of the Circuit Court where the case originated. There are two types of Illinois Notice of Appeal: an Appeal of Right and an Appeal of Discretion. An Appeal of Right is used when the judgment or decision of the lower court was final, and the appealing party wishes to challenge it. An Appeal of Discretion is used when the lower court has yet to make a final decision, and the appealing party wishes to have the court review the decision. When filing an Illinois Notice of Appeal, the appealing party must provide the court with a copy of the original judgment or decision, as well as a statement of the grounds for appeal. The Notice of Appeal must also include a designation of the record that will be used during the appeal process.
