An Illinois Agreed Parentage Order is a form of legal recognition for unmarried parents in the state of Illinois. It is a document that establishes the legal relationship between a child and both of their parents. The order also grants the same rights and obligations to both parents as if the child were born to married parents. There are two types of parentage orders available in Illinois: Joint Parentage Orders and Sole Parentage Orders. A Joint Parentage Order is issued when both of the child's parents agree that they are the legal parents of the child and both parents sign the Order. This type of Order establishes both parents as legal guardians of the child and grants them the same rights and responsibilities. A Sole Parentage Order is issued when only one parent is listed as the legal parent of the child. This Order grants the parent full legal parental rights and responsibilities, but the other parent is not listed on the order. In both cases, a court order must be filed with the local county clerk in order for the Illinois Agreed Parentage Order to be valid. Once the order is registered, it is legally binding and provides the same protections as a marriage for the child and both parents.
