Illinois Joint Trial Conference Memorandum (TCM) is a legal document created by the parties involved in a civil case in the State of Illinois. It is used to document the results of a Joint Trial Conference (JTC) which is a meeting between the parties (usually the plaintiff and defendant) and their attorneys. The purpose of the JTC is to attempt to reach an agreement without having to go to court. The TCM is a written summary of all matters discussed during the JTC, including the parties' positions, evidence, and arguments. It also includes an agreed-upon statement of facts, a list of proposed orders, and any other pertinent information related to the case. The memorandum is signed by all parties and attorneys present at the JTC and serves as evidence of the agreement. There are three types of Illinois Joint Trial Conference Memorandum: a Neutral TCM, a Joint TCM, and a Non-Joint TCM. A Neutral TCM is used when the parties are unable to come to an agreement during the JTC and the case is assigned to a neutral third-party mediator. A Joint TCM is used when the parties are able to come to an agreement and the case is dismissed. A Non-Joint TCM is used when the parties are unable to come to an agreement and the case is referred to court.
