An Illinois Emergency Order of Protection is a civil court order issued in the state of Illinois that prohibits an individual from having contact with another person. This type of order is designed to protect the safety of the person who is requesting protection from the person who is subject to the order. There are two types of Illinois Emergency Order of Protection: an Emergency Plenary Order of Protection and an Emergency Stalking No Contact Order. An Emergency Plenary Order of Protection is issued when the court finds that an individual is in immediate and present danger of abuse, harassment, or stalking. The order can require the respondent to stay away from the petitioner, their residence, and other specified locations. It can also require the respondent to pay for the petitioner's medical bills, lost wages, and attorney’s fees. An Emergency Stalking No Contact Order is issued when the court finds that an individual has been the victim of stalking. The order can prohibit the respondent from having contact with the petitioner and can also require the respondent to stay away from the petitioner’s residence and other specified locations. Both types of Emergency Orders of Protection are usually effective immediately and are valid for a period of 14 days or until the court can hold a full hearing on the matter.
