An Illinois Motion to Modify/Suspend/Terminate Support is a legal document that is filed in Illinois family courts to request changes in an existing child support order. The motion can seek to modify the existing child support order, suspend the existing child support order, or terminate the existing child support order. A Motion to Modify Support seeks to alter the existing child support order for any of the following reasons: a change in the financial circumstances of either parent, a change in the health care needs of the child, the emancipation of the child, or a change in the parenting plan. A Motion to Suspend Support is filed when the paying parent is temporarily unable to make payments. Reasons for suspension of child support can include job loss, incarceration, or military deployment. A Motion to Terminate Support is filed when the parent paying child support no longer has an obligation to pay. Reasons for termination of child support include when the child reaches the age of emancipation, when the child marries, or when the child joins the military. These motions are typically filed by attorneys on behalf of their clients, but can also be filed pro SE (without an attorney).
