Indiana Chapter 13 Debtor's Certifications Regarding Domestic Support Obligations and Section 522(q) are legally binding documents that must be signed by a debtor filing for Chapter 13 bankruptcy in Indiana. These documents require that the debtor certifies that they have provided and will continue to provide full and timely payment of any domestic support obligations (DSO's) owed to any creditors, including child support, alimony, and/or other related court-ordered payments. Furthermore, Section 522(q) requires that the debtor certifies that they will use all disposable income from their bankruptcy repayment plan to satisfy domestic support obligations. There are two types of Indiana Chapter 13 Debtor's Certifications Regarding Domestic Support Obligations and Section 522(q): the Original Certification and the Revised Certification. The Original Certification must be signed by the debtor and filed as part of the bankruptcy petition. The Revised Certification must be signed by the debtor and filed with the Bankruptcy Court at least 15 days prior to the confirmation hearing. The Revised Certification must include all changes to the debtor's DSO's since the filing of the Original Certification.
