The Kentucky Order for Recovery of Necessary Expense in Defense of Indigent (HORNED) is a program that provides legal assistance to indigent (low-income) defendants in criminal cases. This program is administered by the Kentucky Department of Public Advocacy (DPA). The HORNED program allows indigent defendants to receive payment for necessary expenses associated with their defense, including attorneys’ fees, expert witness fees, and court costs. There are two types of HORNED orders: non-recurring and recurring. A non-recurring HORNED order is used to pay for one-time expenses related to a criminal case, such as expert witness fees or court costs. A recurring HORNED order is used to pay for ongoing expenses, such as attorneys’ fees, for as long as the case is active. In order to qualify for HORNED, defendants must meet certain income and asset requirements. Additionally, defendants must demonstrate that they cannot pay for their legal expenses without assistance.
