The Kentucky Transfer of Claim Other Than For Security is a contract between two parties in which one party transfers their legal claim against another to a third party. This third party is generally a different party than the one originally holding the claim against the second party. This type of transfer is usually done to protect the original claimant or assignee from future financial liability. There are two types of Kentucky Transfer of Claim Other Than For Security: voluntary and involuntary. Voluntary transfers occur when the original claimant willingly assigns their claim to a third party. Involuntary transfers occur when a third party is assigned to the claim against the second party against the original claimant’s wishes. In either case, the transfer requires both parties to sign the transfer document and have it notarized. The transfer is then recorded in the county Clerk’s Office. Once this is done, the third party is then responsible for any and all claims against the second party.
