A Kentucky Waiver of Rule 32.1 Hearing is a legal proceeding conducted by a Kentucky court in order to determine whether a party waives his or her rights under the Kentucky Rules of Civil Procedure Rule 32.1. This hearing is also known as a Rule 32.1 waiver hearing. The hearing may be conducted as either a bench trial or a jury trial. The purpose of the hearing is to determine whether a party has waived his or her right to a Rule 32.1 hearing by failing to timely file a motion for such a hearing. If the court finds that a party has waived his or her right to a Rule 32.1 hearing, the court may enter a judgment that is final and binding on all parties. There are two types of Kentucky Waiver of Rule 32.1 Hearings: an original waiver hearing and a post-judgment waiver hearing. In an original waiver hearing, the court must determine whether a party has waived his or her right to a Rule 32.1 hearing by failing to timely file a motion for such a hearing. In a post-judgment waiver hearing, the court must determine whether a party has waived his or her right to a Rule 32.1 hearing by failing to timely challenge the judgment or verdict.
