The Kentucky Order of Discharge and Dismissal Under 18 U. S. C. 3607(a) is an order that provides relief from federal criminal prosecution for certain individuals. It is available for individuals who are charged with a federal offense, but who have not been convicted of the offense. Specifically, it applies to individuals who are being prosecuted for a federal offense but who have been found to be not guilty by reason of insanity, or whose offenses have been dismissed, or who have been granted relief under 18 U.S.C. § 3607. The order is issued by the Kentucky Supreme Court and is effective in all federal courts in the state of Kentucky. There are two types of Kentucky Order of Discharge and Dismissal Under 18 U. S. C. 3607(a): a full release, which releases an individual from all criminal liability arising out of the federal offense, and a limited release, which releases an individual from criminal liability arising from the offense, but does not expunge any criminal records associated with the offense.
