A Kentucky Motion to Proceed In Form Paupers on Appeal (IFP) is a legal document that allows a defendant or appellant to file an appeal without having to pay the filing fees associated with the case. It is filed in the Kentucky Court of Appeals or the Kentucky Supreme Court. There are two types of Kentucky Motion to Proceed In Form Paupers on Appeal: a “regular” IFP motion and a “certificateindigenceency” IFP motion. The regular IFP motion is used when the appellant or defendant is unable to pay the filing fees due to a lack of funds. The appellant or defendant must submit a statement of their financial resources, along with a signed affidavit listing their assets and debts. The certificate of indigence IFP motion is used when the appellant or defendant is unable to pay the filing fees due to extreme poverty. The appellant or defendant must submit a statement of their financial resources, along with a signed affidavit listing their assets and debts, and a statement from the court-appointed attorney that verifies their indigent status. The Kentucky Motion to Proceed In Form Paupers on Appeal must be filed within 30 days of the filing of the notice of appeal.
