Description Louisiana Notary Acknowledgement

This affidavit (with acknowledgment) is executed in accordance with La. R.S. 9:5501, which provides for the execution by an owner of immovable property of an affidavit distinguishing himself from judgment debtor of similar name. The holder of the judgment must sign an acknowledgment within fifteen days of receipt, or be liable for costs as provided in the statute. In the event that the judgment creditor refuses to comply or cannot be located, La. R.S. 9:5503 allows the owner to file the affidavit of distinction without the creditor's acknowledgment upon proof of mailing by registered mail to the affected creditor(s).
