Louisiana Release by Obliged of Record (La. R.S. 9:5169) is a process by which a creditor releases the lien on a debtor's property, thereby allowing the debtor to take title to the property. The creditor is known as the obliged, and the debtor is referred to as the obliged. The release is recorded in the public records of the parish in which the property is located. There are two types of Louisiana Release by Obliged of Record (La. R.S. 9:5169): (1) full release and (2) partial release. A full release is a complete release of the lien, while a partial release releases only a portion of the debt owed. The obliged must sign and record the release in order for it to be valid. The obliged must also provide a copy of the release to the obliged. The release must be signed and dated by the obliged and include the following information: the obliged's name, address, and phone number; the obliged's name; the property address; the parish in which the property is located; the amount of the debt released; and the date on which the lien was released. Once the release is signed, dated, and recorded, it is final and cannot be revoked.
